PLEASE read our Terms and Conditions carefully before booking any classes/courses/workshops or signing up for SYNERGY membership. All clients are solely responsible for reading and following our guidelines so everyone can have an enjoyable and safe session, while we maintain and sustain our community studio. By signing up for membership, attending class and signing in during each class participation, you have read the TERMS and are agreeing to all our guidelines and policies.

These Terms of Service (these “Terms”) establish the terms and conditions that govern your access to and use of our studio (indoor & outdoor), facilities, websites, virtual classes and mobile applications, including any content or information provided as part of these services (collectively referred to herein as the “Services”.)

By accessing, browsing, downloading, using or registering for our Services, you are accepting and agreeing to be bound by these Terms and our Privacy Policy, and you are entering into a legally binding agreement with SYNERGY STUDIOS, LLC., and the family of events and activities operating under the SYNERGY STUDIOS brand (collectively referred to herein as “SYNERGY STUDIOS,” “we,” or “us”).

We try and offer you the best services possible. In order to do that, please be sure that you're booking the correct service and can attend classes, workshops, and be able to use the membership or services in the specified time allotted. We do not offer refunds of classes, memberships or workshops purchased.  Its your responsibility to read our guidelines before purchasing. Non use of services are not grounds for a refund. In some instances, per our discretion we can apply a credit to your account.

OUR COMMITMENT TO YOU

We will respect your personal decisions, and allow you to make your own decisions about what exercise you can carry out. However, we ask you not to exercise beyond what you consider to be your own abilities.

We will make every reasonable effort to make sure that our equipment and facilities are in a safe condition for you to use and enjoy.

We will take all reasonable steps to make sure that our staff are qualified to the fitness industry standards as set out by the register of exercise professionals.

If you tell us that you have a disability which puts you at a substantial disadvantage in accessing our equipment and facilities, we will consider what adjustments, if any, are reasonable for us to make.


YOUR COMMITMENT TO US

You should not exercise beyond your own abilities. If you know or are concerned that you have a medical condition which might interfere with you exercising safely, before you use our equipment and facilities you should get advice from a relevant medical professional and follow that advise.

You should make yourself aware of any rules and instructions, including warning notices. Exercise carries its own risks. You should not carry out any activities which you have been told are not suitable for you.

You should let us know immediately if you feel ill when using our equipment or facilities. Our staff members are not qualified doctors, but there will be a staff member available who has first-aid training.

If you have a disability, you mush follow any reasonable instructions to allow you to exercise safely.

Bookings & CLASS CANCELLATION POLICY

 

BOOKING A CLASS

Your membership may entitle you to book classes or activities which are included in your membership.

In order to make booking fair and sustainable for all our members we ask that all members are considerate of others and do not book an unreasonable number of sessions which may have an impact on other members’ ability to use their membership. Should members book multiple daily sessions we reserve the right to cancel any bookings we deem to be excessive including any sessions that are sequential where it is clear that the customer could not undertake both at the same time.

Advance bookings can be made monthly online via our website, or in person at our premises (subject to availability). It is your responsibility to ensure that you have made your booking and submitted payment correctly.


CANCELLING A BOOKING - $10

You many cancel your booking, without charge, up to 24 hours before the start of the session/class that you have booked. If you’re a non Synergy Member, a refund will be made to your chosen payment method or you will be given the opportunity to book another available class of the same cost (providing the re-scheduled date is within 24-48 hours of cancellation date.)

If you cancel your booking within the 24 hours before the start of the session/class you have booked, you will be charged a cancellation fee of $10. Fees may be deducted with your credit card on file.

If you cancel a previously made booking within 24 hours of the allocated start time, no refund will be given, but you will be given the opportunity to book onto another class of the same cost.

You may cancel a booking on the website, by phone or in person at the studio.


NO-SHOW POLICY
A no-show is when a member misses a class or does not show up without cancelling 24 hours prior to the scheduled class time. In this case, you will be charged a “no show” fee of $10.


SINGLE CLASS DROP-IN

If you’re currently not a Synergy Studios member and would like to avail of classes on the schedule, the drop in rate for all Adult classes is $15.


CANCELLATION BY US

In the event that we cancel a class/classes or workshop/event that you have booked, for reasons outside of our control we will contact you by email or telephone to let you know. At the time of cancellation we will offer you the choice between receiving a full refund or being transferred to a class/workshop at an alternative date and time.

We may cancel your membership without notice if you commit a material breach of this agreement including, but no limited to, a breach of the SYNERGY STUDIOS rules, abuse or threatening behavior or vandalism or illegal activity.

We may cancel your membership without notice if you continually fail to cancel class.

We may cancel your membership with immediate effect if:
you have breached any terms and conditions of this agreement; or
membership fees or other charges remain unpaid 7 days after the due date
such a breach is not remedied by you within seven (7) days, after being notified by us.


BOOKING CONFIRMATION

Your booking is not complete until you have received a booking confirmation. Please make sure you receive a booking confirmation before you attend the class. If you do not receive confirmation please contact us by phone, email or in person.

PAYMENT AND PRICING

  • Payment for your class/course/workshop may be made by cash in person or online via credit card or debit card. Payments can be made online, via phone, or in person at the main Synergy Studio location at the PNR building.

  • Membership Fees are due each month. If your Membership fees become overdue, we reserve the right to refuse you entry into our classes/courses/workshops until the overdue sums are paid in full. Should you default payments to us, we reserve the right to notify the default to a credit reference agency or other third party to obtain payment from you.

  • Synergy Studios reserve the the right to review and change membership fees periodically. Your membership fees will remain the same as at your membership start date. Once your membership has come to an end, the membership fee will be charged at the time of the renewal

MEMBERSHIP SUSPENSION & membership transfer

 

We offer the opportunity to temporarily suspend or “freeze” your membership in the event of prolonged absence such as serious illness or injury. This benefit is for monthly general/contractual fitness memberships. This benefit applies for full calendar months and available for a minimum of 1 calendar month up to a maximum of 3 calendar months pending management approval.

Between the months of January 2021 and March 2021 inclusive, freezes for fitness memberships will be allowed free of charge due to COVID restrictions.

Freezes can only commence after the first direct debit has been taken (including any pro rate payment). Any promotional offer or discount period attributed to the freeze period will not be extended. To activate this benefit, please request a suspension of your membership in-house by talking to a Synergy Studios team member before the 15th of the month to be effective the 1st of the following month, as you will need to agree to the term of the freeze.

At the end of the frozen period your monthly debit will revert to the appropriate fee automatically.


Neither Member nor unauthorized agent will sell, assign, or transfer this Agreement, or his/her membership to Synergy Studios, or any other right or privilege herein or therein contained.

The entire Synergy Studios may be temporarily closed for holidays and for periods of up to two months each year for maintenance purposes without extensions to your membership.

Closures ordered by local, state, or national government is not a cause for refunds of any kind. Should the facilities be unavailable for use at any other time, due to damage by acts of God, catastrophe, accident or other reason beyond the control of Synergy Studios, the membership term will be extended for a period equal to the time of such unavailability.

Specific areas may be closed for maintenance or remodeling purposes from time to time for up to 60 days without extensions or compensation to your membership.

MEMBERSHIP CANCELLATION/
termination POLICY

 

To cancel your membership agreement, provide verbal and/or written notice which states that you, the buyer, are canceling your Synergy Membership Agreement, or words of similar effect. Such notice shall be emailed to synergystudios…. You will receive confirmation that you cancellation has been processed and is complete. If you do not receive confirmation your account is STILL ACTIVE. All accounts must be paid in full to be considered cancelled. SYNERGY STUDIOS does accept cancellation of memberships over the phone. Synergy Studios, at its discretion, may terminate membership if the monthly payments are interrupted or discontinued for any reason; if the Member fails to follow any of the Synergy polices and rules or violates any part of the the Membership Agreement; or if the Member’s conduct is improper or harmful to the best interest of the Studio or any other members, instructors, staff and owners. The Member is liable for all financial obligations to that date. Synergy Studios also reserves the right to terminate your membership for any reason without refund not stated in this Agreement nor as prohibited by law. The member may not be allowed to use the Synergy Studios facilities after such cancellation. A Member’s heirs or representatives have the right to cancel this agreement and Membership contract in the event of a death of a Member. If the Member becomes disabled or unable to receive all services as contracted due to disability, the Member shall have an option to extend the duration of the contract for a period equal to the duration of the disability up to a maximum of six (6) months. The Member agrees that in the event he/she claims disability, he/she shall submit copies of his/her physician’s applicable records which precludes the Member from using the facilities or services of the Studio and the condition is verified by a physician legally authorized to practice medicine.

The general rules & Conduct

 

We expect our Members to behave in a considerate manner and will not accept any aggressive behavior towards other members, staff, instructors or our colleagues. We reserve the right to refuse admission for members behaving in such a manner.

The Member agrees to abide by all regulations of Synergy Studios as it appears in this Agreement now in effect or to become effective at a future date. All signs posted in the studio or on the premises shall be considered a part of the rules and regulations.


  1. Members are to always check in and sign in at the FRONT DESK upon arrival or after returning to the Studio.

  2. Members are expected to leave the premises by closing time.

  3. No loud or abusive language permitted.

  4. No alcohol, smoking, vaping or drugs are allowed on the premises.

  5. No sale, distribution or promotion of prescription or non-prescriptive drugs.

  6. No personal notice, advertising, or other literature, either posted or for distribution is allowed.

  7. No adjustments to the sound systems, air conditioner, fans, or other equipment.

  8. Cups, papers, bottles, and trash must be disposed of in the proper receptacles provided.

  9. Members must wipe down equipment after use and re-rack their weights.

  10. Excessive smells are not allowed.

  11. Children and young people under the age of 16 must be supervised by an adult at all times.

  12. There is a 30-minute limit on the cardio machines if others are waiting.

  13. Equipment is to be shared at all times. This includes “Super Setting.”

  14. Cell phone use must be non-disruptive to other members.

  15. Members are not allowed to train or give instruction to other members.

  16. No inappropriate behavior is allowed. Will result in immediate termination without refund.

EXERCISE FLOOR RULES

  1. Members must wear appropriate exercise wear and clean athletic shoes. swimsuits, underwear, open toed shoes, street clothes, offensive attire and jeans are not allowed.

  2. No food or drinks are allowed on the exercise floor.

  3. No hard or black soled exercise shoes are allowed in the group exercise floor (Barre Studio).

  4. Members must replace all free weights on appropriate racks after use. Free weights are to be lowered carefully to the floor upon completion of exercise. Abuse of any equipment will not be tolerated. Machines or bars may not be overloaded.

  5. Members must use safety belts and/or stops whenever they are provided on any exercise equipment.

liability for personal property, injury, illness and death

 

Synergy Studios is not liable to you or your guest for articles, including automobiles or their contents, that are damaged, lost or stolen while in or about the Synergy Studios premises including parking lots. If you or your guest cause any damage to the Synergy Studios facilities, you are liable to the Synergy Studios for the cost of repair or replacement.

Open cubby spaces are provided for storage of your personal possessions. Storing personal possessions in these open spaces at your own risk. We will not be liable for any loss, damage or theft of any property you bring onto Synergy Studios premises.

Synergy Studios will not be liable to you for any loss or damage you may suffer where the same is attributed to your own fault; a third party unconnected with our provision of services under this agreement; or events which neither we nor our suppliers could have reasonably foreseen or forestalled even if we had taken reasonable care.


Nothing in these terms and conditions is intended to limit or exclude our liability for death or personal injury caused by our negligence of for fraud, fraudulent misrepresentation or any other liability which cannot be excluded by law.

eligibility of Services

 

To use the Services, you must be (a) eighteen (18) year of age or older; or (b) at least (14) years of age and using the Services with prior written consent of your parent or guardian; and (c) located in the United States.

All kids and youth participating in “kidz classes” on the Synergy Studios class schedule under the age of eighteen (18) must be signed in and accompanied by an adult at all times.

By accessing or using the Services, including solely for browsing purposes, you are representing to Synergy Studios that you meet the foregoing requirements, and you or your parent or guardian, as applicable, have the legal capacity to enter into and be bound by these Terms.

We welcome feedback which allows us to celebrate the positive impact we have when going about our business, along with using constructive criticism to help inform how we run our services for your benefit.

Everyone loves positive feedback and where we have gone above and beyond the call of duty it’s always nice to hear that. This allows us to thank the colleague that has delivered outstanding service levels and celebrate their commitment to you, the customer.

We also recognize that from time to time we may not deliver the service levels that we, or you, expect and on those occasions we welcome your views which can help us to rethink, redesign or retrain in an effort to improve what we do.

You, as the customer, may also have an idea that you believe would add benefit to our business which we may not have thought of and we would love to hear those.

In an effort to provide a clear and concise way for you to give us feedback we have developed the process below which we ask you to follow in order that we can deal with your feedback in the quickest and most positive way possible.


The quickest and most efficient way to give feedback is in person to either the General Manager immediately. This way most cases can be dealt with and resolved quickly. All of our Synergy team members will be able to support you in making contact with the right person at site.

Alternatively you can email us directly at synergystudios671@gmail.com and your feedback will be sent to the relevant individual for the site concerned.


Our aim is to provide a response within 48 hours as a minimum. This may just be a holding response if the feedback requires additional investigation. If this is the case we will inform you of this and under these circumstances our aim is to provide a full response and resolution within seven (7) days.
